General Terms and Conditions (GTC)
1. Scope
1.1
These General Terms and Conditions (hereinafter referred to as "GTC") of Rene Hartmuth (hereinafter referred to as the "Seller") shall apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter referred to as the "Customer") and the Seller with regard to the goods presented in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby excluded unless otherwise agreed.
1.2
A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.
1.3
An entrepreneur within the meaning of these GTC is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their commercial or independent professional activity when entering into a legal transaction.
2. Conclusion of Contract
2.1
The product descriptions displayed in the Seller's online shop do not constitute binding offers but serve as an invitation for the Customer to submit a binding offer.
2.2
The Customer may submit an offer via the integrated online order form. By placing selected goods into the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer by clicking the button that completes the order process.
2.3
The Seller may accept the Customer's offer within five days by:

Sending a written order confirmation or confirmation in text form (e.g., email);

Delivering the ordered goods; or
-
Requesting payment from the Customer after the order has been placed.
The contract is concluded at the time the first of these alternatives occurs.
2.4–2.9
Additional provisions apply regarding contract conclusion through payment providers such as PayPal and Amazon Payments, storage of contract text, correction of input errors, available contract languages, and electronic communication during order processing.
3. Right of Withdrawal
3.1
Consumers generally have a statutory right of withdrawal.
3.2
Further details regarding the right of withdrawal can be found in the Seller's separate withdrawal policy.
4. Prices and Payment Terms
4.1
Unless otherwise stated in the product description, all prices are total prices. No VAT is charged because the Seller operates under the German small business regulation and is exempt from VAT. Additional shipping and delivery costs, where applicable, are displayed separately.
4.2
For deliveries outside the European Union, additional costs such as bank transfer fees, exchange rate fees, customs duties, taxes, or import charges may arise and shall be borne by the Customer.
4.3
The available payment methods are displayed in the online shop.

Payments may be processed through various providers including:

5. Delivery and Shipping Conditions
5.1
Goods are delivered to the delivery address specified by the Customer within the Seller's designated delivery area unless otherwise agreed.
5.2
If delivery fails for reasons attributable to the Customer, the Customer shall bear the reasonable costs incurred as a result. This does not apply where the Customer effectively exercises their right of withdrawal.
5.3
The transfer of risk follows statutory provisions. For consumers, risk generally passes upon delivery of the goods.
5.4
The Seller reserves the right to withdraw from the contract in the event of incorrect or improper self-supply, provided the Seller is not responsible for the non-delivery and has exercised due diligence in procuring the goods.
5.5
Collection of goods by the Customer is not possible for logistical reasons.
6. Retention of Title
Ownership of the delivered goods remains with the Seller until full payment of the purchase price has been received.
7. Warranty (Statutory Defects Liability)
7.1
The statutory warranty provisions apply unless otherwise specified below.
For business customers:

The Seller may choose the method of remedy.

Warranty claims for new goods expire after one year.

Warranty claims for used goods are excluded.

Replacement delivery does not restart the limitation period.
7.2
The above limitations do not apply to:

Claims for damages,
-
Fraudulent concealment of defects,

Building-related products causing structural defects,
-
Obligations to provide updates for digital products.
7.3–7.5
Further statutory rights remain unaffected. Consumers are requested to report obvious transport damage upon receipt, although failure to do so does not affect legal warranty rights.
8. Liability
8.1
The Seller shall be liable without limitation:

In cases of intent or gross negligence,

For injury to life, body, or health,
-
Under an express guarantee,
-
Under mandatory statutory liability provisions (e.g., product liability law).
8.2
In cases of negligent breach of essential contractual obligations, liability is limited to foreseeable and typical contractual damages.
8.3
Any further liability is excluded.
8.4
These liability provisions also apply to the Seller’s legal representatives and agents.
9. Special Conditions for Goods Processed According to Customer Specifications
9.1
Where goods are processed according to customer instructions, the Customer is responsible for providing all necessary content (e.g., texts, images, graphics) and ensuring that all required rights have been obtained.
9.2
The Customer shall indemnify the Seller against third-party claims arising from infringement of intellectual property or other rights.
9.3
The Seller reserves the right to reject orders containing unlawful, offensive, discriminatory, extremist, harmful, or otherwise inappropriate content.
10. Redemption of Promotional Vouchers
10.1–10.9
Promotional vouchers:

Are only valid within the specified validity period.
-
May exclude certain products.
-
Must be redeemed before the order is completed.
-
Only one voucher may be used per order.
-
Cannot be exchanged for cash.
-
Are not refunded if goods purchased with the voucher are returned.

Are non-transferable unless explicitly permitted.
11. Applicable Law
The law of the Federal Republic of Germany shall apply to all legal relationships between the parties.
For consumers residing in another country, mandatory consumer protection provisions of their country of residence remain unaffected.
12. Alternative Dispute Resolution
The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
